Agreement Between User and https://cnei.edu
Welcome to https://cnei.edu (the “Site”). The Site is operated by California Nurses Educational Institute (“CNEI”).
Your access and use of this Site signify your agreement to comply with and be bound by the following Terms and Conditions (the “Terms”). Please read these Terms carefully and retain a copy for your records.
CNEI operates this E-Commerce Site to provide educational programs, including but not limited to:
- Licensed Vocational Nurse (LVN) Program 
- Certified Nurse Assistant (CNA) Program 
- Certified Home Health Aide Program 
- Pharmacy Technician Program 
- Alcohol and Drug Addiction Counseling Program 
Privacy
Your use of this Site is subject to CNEI’s Privacy Policy. Please review the Privacy Policy, which governs data collection and usage and forms part of these Terms.
Electronic Communications
By visiting https://cnei.edu or sending emails to CNEI, you engage in electronic communications.
You consent to receive communications from CNEI electronically and agree that all agreements, notices, disclosures, and other communications provided electronically — whether via email or posted on the Site — satisfy any legal requirement that such communications be in writing.
Your Account
If you create an account on this Site:
- You are responsible for maintaining the confidentiality of your account credentials and restricting access to your computer. 
- You accept full responsibility for all activities occurring under your account or password. 
- You may not assign or transfer your account to any other person or entity. 
CNEI is not responsible for unauthorized access to your account resulting from theft or misuse of your login information.
CNEI reserves the right, in its sole discretion, to:
- Refuse or cancel service, 
- Terminate accounts, or 
- Remove or edit content. 
Children Under Thirteen
CNEI does not knowingly collect personal information, online or offline, from individuals under the age of thirteen (13).
If you are under eighteen (18) years of age, you may use https://cnei.edu only with the permission and supervision of a parent or legal guardian.
Cancellation and Refund Policy
CNEI follows Section 94919(c) of the California Code, which requires a pro-rata refund of non-federal student financial aid paid for institutional charges to students who complete 60 percent or less of the program.
Refunds are calculated as follows:
- The number of days the student attended (or was scheduled to attend) before withdrawal, divided by the total number of days in the program. 
- All amounts paid in excess of the calculated obligation shall be refunded, except as provided in Section 3 below. 
- The STRF assessment, $100 registration fee, and the cost of unused books, supplies, or equipment returned within ten (10) business days of withdrawal may be deducted. 
Books, supplies, or equipment that are unused and in original sealed packaging may be returned for credit equal to the amount charged by the institution.
Links to Third-Party Sites / Services
The Site may contain links to other websites (“Linked Sites”). These Linked Sites are not under the control of CNEI.
CNEI is not responsible for:
- The content of any Linked Site, 
- Any link contained within a Linked Site, or 
- Any changes or updates to such sites. 
Links are provided for convenience only and do not imply endorsement or association with the operators of those sites.
Certain services on the Site may be provided by third-party organizations. By using those services, you consent to CNEI sharing relevant information and data with those contracted third parties as necessary to deliver the requested service.
No Unlawful or Prohibited Use / Intellectual Property
You are granted a non-exclusive, non-transferable, revocable license to access and use https://cnei.edu in accordance with these Terms.
As a condition of use, you agree not to use the Site:
- For any unlawful or prohibited purpose; 
- In a manner that could damage, disable, overburden, or impair the Site; or 
- To interfere with another party’s use and enjoyment of the Site. 
All content on the Site — including text, graphics, logos, images, software, and their compilation — is the property of CNEI or its suppliers and protected under copyright and intellectual-property laws.
You agree to:
- Respect all proprietary notices and copyright legends; 
- Use the content solely for personal and non-commercial purposes; 
- Not modify, copy, distribute, transmit, display, publish, or create derivative works from the Site’s materials without written permission from CNEI. 
Your use of the Site does not transfer ownership of any intellectual property rights.
Use of Communication Services
The Site may include communication features such as discussion boards, forums, or community areas (“Communication Services”). You agree to use these features only to post and receive messages and materials that are appropriate and lawful.
When using a Communication Service, you shall not:
- Defame, harass, threaten, or violate others’ rights of privacy or publicity; 
- Upload or share unlawful, obscene, or defamatory content; 
- Upload files containing viruses, corrupted files, or software that may harm another’s computer; 
- Advertise or sell goods or services unless specifically permitted; 
- Conduct surveys, contests, or chain letters; 
- Falsify author attributions or legal notices; or 
- Restrict or inhibit others’ use of the services. 
CNEI reserves the right to monitor and, if necessary, remove any material from its Communication Services at its discretion.
Use caution when sharing personal information. CNEI disclaims responsibility for user-generated content or interactions within these services.
Materials Provided to CNEI or Posted on the Site
CNEI does not claim ownership of materials you provide or post (“Submissions”).
However, by submitting content, you grant CNEI and its affiliates a license to:
- Copy, distribute, transmit, publicly display, perform, reproduce, edit, translate, and reformat your submission; and 
- Publish your name in connection with your submission. 
You warrant that you own or control all rights necessary for your submission. CNEI may remove any submission at any time and has no obligation to use submitted materials.
No compensation will be paid for such use.
Third-Party Accounts
You may link your CNEI account to third-party accounts. By doing so, you consent to the continuous release of information about you to those third-party platforms according to your privacy settings.
If you do not wish to share such information, do not enable this feature.
International Users
The Site is operated from offices in the United States. Users accessing the Site from outside the U.S. are responsible for compliance with all local laws.
You agree not to use or export CNEI content in violation of U.S. laws or regulations.
Indemnification
You agree to indemnify and hold harmless CNEI, its officers, directors, employees, agents, and third parties from all losses, liabilities, costs, or expenses (including reasonable attorney’s fees) arising from:
- Your use or inability to use the Site or its services, 
- Any postings made by you, 
- Your violation of these Terms, 
- Your infringement of third-party rights, or 
- Your violation of any applicable law. 
CNEI reserves the right, at its own expense, to assume exclusive defense and control of any matter subject to indemnification. You agree to fully cooperate in such defense.
Arbitration
Any dispute arising out of or relating to these Terms shall be resolved through final and binding arbitration under the Federal Arbitration Act.
Arbitration shall be conducted by a neutral arbitrator appointed by the American Arbitration Association or another agreed-upon service. The arbitrator’s decision shall be final, and judgment may be entered in any court of competent jurisdiction.
The prevailing party in any arbitration or legal proceeding shall be entitled to recover reasonable attorney’s fees and costs.
Class Action Waiver
All disputes must be resolved on an individual basis.
Class actions, collective actions, or representative claims are not permitted.
Unless both parties agree otherwise, the arbitrator may not consolidate multiple claims or preside over any form of class or representative proceeding.
Liability Disclaimer
The information, software, products, and services available through the Site may contain inaccuracies or typographical errors. Updates and changes may be made at any time.
CNEI and its suppliers make no representations or warranties regarding:
- The suitability, reliability, availability, or accuracy of the Site’s content or services; and 
- Any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. 
All materials are provided “as is.”
To the fullest extent permitted by law, CNEI and its suppliers shall not be liable for any direct, indirect, incidental, punitive, special, or consequential damages — including but not limited to loss of data, profits, or use — arising from use of or inability to use the Site.
If you are dissatisfied with any portion of the Site, your sole remedy is to discontinue its use.
Termination / Access Restriction
CNEI may terminate or restrict access to the Site and related services at any time, without notice, at its sole discretion.
This Agreement is governed by the laws of the State of California. You consent to the exclusive jurisdiction of California courts for all disputes arising under these Terms.
If any part of this Agreement is deemed invalid or unenforceable, the remaining provisions will continue in full effect.
Unless otherwise stated, this Agreement constitutes the entire understanding between you and CNEI regarding the Site.
Changes to Terms
CNEI reserves the right to modify these Terms at any time. The most current version will supersede prior versions. Users are encouraged to review this page periodically for updates.
